2026:JHHC:15667 IN THE HIGH COURT OF JHARKHAND AT RANCHI A. B. A. No. 2785 of 2026 --- Tahir Miyan @ Tajir Miyan @ Md. Tajid @ Tajir @ Md. Tahir Miyan … … Petitioner Versus The State of Jharkhand … … Opposite Party --- CORAM : HON'BLE MR. JUSTICE RONGON MUKHOPADHYAY --- For the Petitioner : Mr. Ranish Kumar, Advocate For the Opposite Party : A.P.P. --- 2/29.05.2026 Heard Mr. Ranish Kumar learned counsel for the petitioner and learned A.P.P. for the State. The petitioner is apprehending his arrest in connection with Hunterganj P.S. Case No. 62 of 2024. It has been alleged that one Md. Mazhar had taken the photo copy of Aadhar card and photos of the villagers on the assurance of arranging financial benefits to them and later on it came to light that forged Aadar cards were being used by Md. Mazhar for preparation of voter Id cards. Submission has been advanced by the learned counsel for the petitioner that the main allegation of committing forgery is attributed to Md. Mazhar. It has submitted that the petitioner has been implicated on the confessional statement of Md. Mazhar and save and except mere suspicion there is no other material which would suggest about the petitioner being involved in making forged voter Id cards. Learned A.P.P. for the State has opposed the prayer for anticipatory bail of the petitioner. Regard being had to the fact that the main allegation seems to have been leveled against Md. Mazhar and the petitioner has only been suspected to be involved in the offence, I am inclined to extend the privilege of anticipatory bail to the petitioner. Accordingly, the petitioner above named is directed to surrender in the court below within four weeks and pray for bail, and in that event, he shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate, 1st Class, Chatra in connection with 2026:JHHC:15667 Hunterganj P.S. Case No. 62 of 2024 subject to the conditions as laid down under Section 482 (2) of the Bhartiya Nagrik Suraksha Sanhita, 2023. This application stands allowed.
