1. Applicant is accused in case FIR No. 0369/2025, registered at Police Station Crime Branch for commission of offence under Section 20(b)(ii)C of Narcotic Drugs and Psychotropic Substances Act, 1985
2. The applicant was granted interim bail for a period of three weeks on medical and humanitarian grounds by the learned Sessions Court on
09.06.2026. He prayed for extension of such interim bail but such request was declined by the learned Sessions Court vide order dated 29.06.2026.
3. Applicant, thereafter, filed bail application before this Court i.e. Bail Application No. 2475/2026. Such bail application was considered by this Court on 06.07.2026 and after some arguments, learned counsel for applicant sought to withdraw the same with liberty to file it afresh once the applicant This is a digitally signed order. had surrendered.
4. Fact, however, remains that there does not seem to be any change in circumstances as applicant has yet not surrendered.
5. There is also one miscellaneous application whereby applicant is seeking exemption from surrender and grant of interim protection and extension of interim bail.
6. There is no reason assigned as to why in view of the aforesaid specific
order, the present application is maintainable, particularly when the applicant has already been operated upon and has been discharged from the hospital on
30.07.2026.
7. Be that as it may, since there is no appearance from the side of applicant, despite the fact that the matter was passed over, the present application is dismissed-in-default and also for non-prosecution.
8. Other pending applications also stand disposed of in aforesaid terms.
