NARENDRA PRASAD ORAL ORDER This writ petition is filed under Articles 226 & 227 of the Constitution of India, challenging the order dated 08.07.2024 vide Annexure-C, passed by the second respondent, appointing the fourth respondent in place of the petitioner. 2. The petitioner was appointed as Anganwadi worker by order dated 20.09.2022 vide Annexure-A. The petitioner's appointment was called in question by respondent No.4 - Smt.Bhagya before this Court in WP - 3 - HC-KAR NC: 2026:KHC:8061 WP No. 21575 of 2025 No.20240/2022. In the said writ petition there was no interim order staying the appointment of the petitioner. This Court, by order dated 13.04.2023 vide Annexure-B, allowed the writ petition and set aside the appointment order of the petitioner dated 20.09.2022. Thereafter, the petitioner herein filed a review petition in RP No. 275/2023. This Court, by Order dated 10.09.2024 vide Annexure-D allowed the review petition. The relevant paragraph is extracted below: “6. Having taken note of the factual aspects on record, as the review petitioner is the respondent No.4 in W.P.No.20240 of 2022, I am of the view that, as the reasons stated in paragraph 7 of the order dated 13.04.2023 has been made without considering the extended period for filing the application for the post of Anganawadi Worker and therefore, I am of the view that, review petition requires to be allowed and accordingly, the review petition is allowed. Order dated 13.04.2023 in W.P.No.20240 is set aside and the writ petition is restored to file. It is made clear that the respondent-authorities are directed not to disturb the entire arrangement as same may affect the children in the Anganawadi.” - 4 - HC-KAR NC: 2026:KHC:8061 WP No. 21575 of 2025 3. In the meanwhile, the respondent No.2 appointed respondent No.4 by impugned order dated 08.07.2024 vide Annexure-C on the basis of the order passed by this Court in WP No.20240/2022 disposed of on 13.04.2023. In view of recalling the order dated 13.04.2023 passed in WP No.20240/2022 in R.P.No.275/2023, the appointment order of the respondent No.4 vide Annexure-C has to be withdrawn by the respondent No.2. Since the respondent No.2 has not withdrawn that order, the petitioner is before this Court challenging Annexure C. 4. In view of recalling the order dated 13.04.2023 in WP No.20240/2022, the impugned order at Annexure C has to be set aside. Accordingly, the following order: (i) The writ petition stands disposed of. (ii) The appointment order of the petitioner dated 20.09.2022 vide Annexure A is restored subject to the result of W.P.No.20240/2022. - 5 - HC-KAR NC: 2026:KHC:8061 WP No. 21575 of 2025 (iii) The respondent No.2 is directed to continue the petitioner as Anganawadi worker, Madhuvanahalli Anganawadi Centre. (iv) It is made clear that the restoration of Annexure A and continuation of the petitioner as Anganawadi worker is subject to the result of the writ petition which is filed by the respondent No.4 in WP No.20240/ 2022.
