2. By this petition under Section 483 of the BNSS, 2023 has been filed by the accused-petitioner, namely, Sainuddin, praying for grant of bail in connection

3. The petitioner was arrested on 30.07.2026.
4. The allegation in the FIR dated 01.01.2026 is about attempt to rape and subsequently threatening and assaulting etc. by the accused no. 1. The accused persons are stated to have threatened and assaulted and later accused no. 5 of the FIR, taken away some valuable ornaments.
5. The case has already been charge sheeted and presently pending at the stage of appearance before the court of learned JMFC, Boko, Kamrup.
6. The scanned TCR has been received.
7. The learned Additional Public Prosecutor has drawn attention to statement of the victim woman recorded under Section 183 BNSS.
8. The learned counsel for the petitioner submits that four of the co-accused has already been enlarged on bail.
9. Considering all aspects, the petitioner can be granted bail at this stage subject to suitable condition(s).
10. Accordingly, the accused-petitioner, named above, shall be released on bail in connection with Boko P.S. Case No. 02/2026 u/s 75(2)/78(2)/329(4)/74/76/64(1)/62/304(2)/3(5) of BNS, 2023, on furnishing bail bond of Rs.50,000/- with one suitable surety of the like amount to the satisfaction of learned JMFC, Boko, Kamrup.
11. The direction for bail is further subject to the conditions:
Page No.# 3/3 (a) The accused person shall available for trial, if one commences; (b) That the petitioner shall not hamper or tamper with evidence; and (c) That the petitioner shall not in any manner harm or harass or intimidate the victim or her family members; (d) That the petitioner shall not try to influence or pressurize or threaten witnesses.
12. Violation or breach of any condition(s) shall entail cancellation of bail.
13. With the above observations, this bail petition stands allowed and
disposed of accordingly.
