JUSTICE P SREE SUDHA ORAL ORDER Learned counsel for the respondent is present. 2. This petition is filed by the wife for transfer of M.C.No.7802/2023 filed by the husband for divorce before the IV Additional Principal Judge Family Court at Bengaluru to Senior Civil Judge and JMFC, Chikkanayakanahalli, Tumkur District. 3. It is stated that after their marriage they are also blessed with a child. Petitioner stated that the respondent has filed initially for restitution of conjugal rights and she enclosed the copy of the petition. She filed vakalath and also filed objections. Criminal Case No.174/2023 is filed by her in Chikkanayakanahalli police station and she also filed another case under Section 125 - 3 - HC-KAR NC: 2026:KHC:8045 CP No. 413 of 2024 of Cr.P.C for maintenance in C.Mis.No.526/2023 and she stated that now she is residing with her parents in the said village of Tumkur District. As such, she requested for transfer of the case. 4. The learned counsel for the petitioner did not appear. 5. Heard the arguments of learned counsel for the respondent and he stated that the case is coming up for cross-examination of the respondent. 6. Therefore, this Court finds that there is no reason to transfer the case at this stage. Hence, the petition being devoid of merit is dismissed.
