Also heard Ms. Vanneihsiami, learned Government Advocate appearing for the respondent Nos. 1 to 6. The present IA has been filed seeking an amendment to the cause title to the extent that the petitioner No. 1 may be struck off. The learned counsel for the applicant has submitted that the petitioner No. 1 in the writ petition had been arrayed as a party since the other petitioners were seeking the relief of being granted family pension on the death of the petitioner No. 1. Having realized that a dead person cannot be made a party to the litigation, the learned counsel for the petitioner prays that the petitioner No. 1 be struck off and the matter be allowed to proceed with regard to the other petitioners. The learned counsel for the respondents does not object to the same. Accordingly, the petitioner No. 1, namely, F. Lalchhawnkima (L) shall stand deleted from the array of parties. However, it is provided that, for the sake of convenience, the serial numbers given to the petitioners shall remain the same. I.A. accordingly stands disposed of.
