Also heard Mr. K K Porasor, learned Additional Public Prosecutor, Assam. By this application filed under Section 482 of the BNSS, 2023 the petitioner, namely, Sri Arup Hazarika, has prayed for pre-arrest bail in connection with PRC No. 1202/2023 pending in the Court of the learned Additional Chief Judicial Magistrate, Dibrugarh. Under Section 319 of the CrPC, the Trial Court issued summon to the petitioner Sri Arup Hazarika. The petitioner apprehends that he might be remanded custody by the Court below if he appears. I have considered the submissions made by the learned counsel for both sides. In the light of the materials available in the record, this Court is of the opinion that, at this stage, the petitioner does not deserve to be detained in custody. Therefore, the prayer of the petitioner is allowed. The petitioner Sri Arup Hazarika is directed to appear before the learned Additional Chief Judicial Magistrate, Dibrugarh in connection with PRC No. 1202/2023 within 10 (ten) days from today. On his appearance, the learned Additional Chief Judicial Magistrate, Dibrugarh shall allow the petitioner to go on bail of Rs.25,000/- with one surety of like amount to the satisfaction of the learned Trial Court.
