02/ 20.03.2026: This bail application has been filed by the petitioner under Sections 483 & 484 of BNSS, 2023 wherein, prayer has been made for grant of bail as he is in custody for allegedly committing offence punishable under Sections 304(B) of the Indian Penal Code.
2. Heard, learned counsel for the petitioner, learned counsel for the State and have also gone through the impugned order.
3. Learned Spl. P.P. opposes the prayer for bail.
4. The bail of the petitioner was cancelled by the Trial Court, on the ground that he could not appear on 08.07.2024 due to death of his father, which resulted in cancellation of bail.
5. Considering the aforesaid fact, I am inclined to grant bail to the petitioner. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II, Giridih, in connection with S.T. No.318 of 2015, arising out of Bengabad P.S. Case No.94 of 2015, corresponding to G.R. No.1633 of 2015, subject to the condition that one of the bailors should be a close relative of the petitioner, having sufficient landed property in his/her own name
within the State of Jharkhand with a further condition that the petitioner shall appear and mark his attendance before the Registrar, Civil Court, Giridih once in a month till the disposal of the trial.
