The petitioners are apprehending their arrest in connection with Jamua P.S. Case No.453/2023. It has been alleged that illegally mined coal was being transported through motorcycles and on checking the vehicles, both the motorcyclists had fled away. Submission has been advanced by the learned counsel for the petitioners that the identification of the petitioners is doubtful since they have been identified by the local Chowkidar. Learned counsel further submits that there are no other materials which would indicate about the complicity of the petitioners in illegal transportation of coal. Learned counsel submits that petitioners do not have any criminal antecedents. Learned A.P.P. for the State opposed the prayer for anticipatory bail of the petitioners. Regard being had to the aforesaid facts, I am inclined to extend the privilege of anticipatory bail to the petitioners. Accordingly, the petitioners above named are directed to surrender in the court below within four weeks and pray for bail, and in that event, they shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate, 1st Class, Giridih in 2026:JHHC:15445 connection with Jamua P.S. Case No.453/2023, subject to the conditions as laid down under Section 482 (2) of the Bhartiya Nagrik Suraksha Sanhita, 2023. This application stands allowed. (Rongon Mukhopadhyay, J) 26th May, 2026.
