6. By way of the present writ petition, the petitioner seeks following reliefs:
“A. Issue a writ, order or direction in the nature of Certiorari or any other appropriate writ, order or direction for setting aside the impugned Order No.3000001682025 dated 30.07.2025 and all consequential actions and proceedings arising therefrom, including Order No. 0100005492024 dated 26.09.2025 rejecting the Petitioner's application for renewal of FCRA Registration, the same being illegal, arbitrary, non-speaking, violative of the principles of natural justice and contrary to the provisions of the Foreign Contribution (Regulation) Act, 2010 and the Rules framed thereunder; AND B. Issuance of a writ, order or direction in the nature of Mandamus directing the Respondents to reconsider and decide afresh the Petitioner's application for renewal of FCRA Registration No. 136760155, strictly in accordance with law after affording an effective opportunity of personal hearing; AND/OR C. In the alternative, issuance of an appropriate writ, order or direction in the nature of Mandamus directing Respondent Nos. 2 and 3 to consider and decide the Petitioner's pending statutory Appeal/Revision preferred under Section 32 of the Foreign Contribution (Regulation) Act, 2010 against Order No. 3000001682025 dated 30.07.2025, after granting an effective opportunity of personal hearing within a time-bound period; AND/OR;”
7. Issue notice. The learned SPC accepts notice on behalf of respondents. 8.
Briefly stated the facts of the present case, as mentioned in the writ petition, are that the petitioner, a charitable and educational society in Varanasi, held FCRA registration for over two decades. Its registration was expired on 29.12.2023, and it applied for renewal on 15.04.2024. During scrutiny, the respondents had questioned an HDFC Bank account which, according to the petitioner, was used solely for domestic transactions and had never received foreign contribution. compounding liability by order dated 30.07.2025. Thereafter, the renewal application was rejected on 26.09.2025 for non-payment of the compounding amount. The petitioner’s statutory appeal/revision under Section 32 of the Foreign Contribution (Regulation) Act, 2010 (hereafter ‘FCRA’) remains pending. By way of the present writ petition, the petitioner challenges the orders as arbitrary and violative of natural justice and seeks reconsideration of its renewal application or a time-bound decision on the pending proceedings. 9. After hearing learned counsels appearing on behalf of the parties and in view of the issue involved in the instant petition, this Court finds it appropriate to direct that the present petition filed before this Court be treated as a representation on behalf of the petitioner, and the respondents are directed to decide the same, within a period of six weeks from date, under intimation to the petitioner herein. 10. In above terms, the present petition stands disposed of. 11. In case of any further grievance, the petitioner will be at liberty to approach this Court by filing fresh writ petition. 12.
