The present Writ Petition has been filed under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking issuance of a Writ in the nature of Habeas Corpus, compelling the respondents to produce and release Mr.Kuldeep Kumar, MLA from East Delhi, who is alleged to have been illegally picked up from his residence at about 4 A.M. on 18.08.2026. When the petition was listed before us on mentioning before Hon’ble the Chief Justice, the learned senior counsel for the respondents, on advance notice, has submitted copies of the General Diary, Police Station: Madhu Vihar, to submit that the husband of the petitioner was indeed taken into preventive detention under Section 65 of the Delhi Police Act, 1978, at about 5:15 A.M. He was later released on the same day, that is, 18.08.2026 at about 3:28 P.M. 3. Though the learned senior counsel for the petitioner contends that the detention of Mr. Kuldeep Kumar was illegal and even otherwise, damage to his property was caused at the time of his detention, for which he needs to be compensated, we are of the opinion that the purpose of the present Writ Petition has been served with the release of Mr. Kuldeep Kumar. For the other reliefs, Mr.Kuldeep Kumar shall be at liberty to initiate appropriate legal action in accordance with law. 4. With the above observation, the petition is disposed of.
