1. The Petitioner is facing disciplinary proceedings arising out of the Charge Memorandum dated 07th February, 2024. The inquiry proceedings have since concluded and the Inquiry Officer has submitted his report dated 11th December, 2025. The said report was furnished to the Petitioner, pursuant to which he submitted his representation dated 05th August, 2026 to the Disciplinary Authority. The said representation raises various factual and legal contentions and relies upon several judicial pronouncements. The representation is presently pending consideration.
2. In view of the aforesaid, Mr. Ashwani Bhardwaj, counsel for the Petitioner, after addressing arguments for some time, submits that the This is a digitally signed order. Petitioner shall reserve all his rights and contentions raised in the writ to be raised at an appropriate stage, should the Disciplinary Authority, upon
consideration of the Petitioner’s representation, pass an order adverse to the Petitioner.
3. Mr. Bhardwaj further submits that, apart from the judgments relied upon in the representation, the judgment of the Supreme Court in Jai Prakash Saini v. Managing Director, U.P. Cooperative Federation Ltd. & Ors.,1 is also relevant to the issues raised by the Petitioner and may be taken into consideration by the Disciplinary Authority. A copy of the said
judgment has been furnished to counsel for the Respondents.
4. In view of the above, and with the liberty as prayed for, the present petition is disposed of with a direction to the Respondents to consider and decide the Petitioner’s representation dated 05th August, 2026, in accordance with law, within a period of three months from today. While doing so, the Respondents shall also take into consideration the judgment of the Supreme Court in Jai Prakash Saini v. Managing Director, U.P. Cooperative Federation Ltd. & Ors.
5. It is clarified that this Court has not expressed any opinion on the merits of the contentions raised by the Petitioner. All rights and contentions of the parties are left open.
6. In view of the above, the present petition is disposed of along with pending application(s).
