1. The Revision Petition, being RC.REV.6/2026, has been filed by the Petitioner under Section 25B(8) of the Delhi Rent Control Act, 1958 challenging the Judgment and Order dated 13.10.2025 passed by the learned ACJ-cum-ARC, North West District, Rohini Courts, New Delhi, in case being RC ARC 73/2018, titled “Vinod Kumar v. Gulab Chand”.

The Application being CM APPL. 52789/2026 has been filed under Order XLI Rule 5 read with Section 151 of the Code of Civil Procedure, 1908 seeking stay of Judgment and Order dated 13.10.2025 passed by the learned ACJ-cum-ARC, North-West District, Rohini Courts, Delhi, in case being RC-ARC 73/2018 as well as the proceedings arising thereof vide Execution Petition bearing No. This is a digitally signed order. 3. The present Application, being CM APPL. 52789/2026, was listed for hearing today, however, with the consent of the parties, the captioned Revision Petition, i.e., RC.REV.6/2026 has also been taken up for hearing.

Learned counsel appearing on behalf of the parties are ad idem that the Petitioner may be permitted to occupy the premises in question for a period of two (02) months from today, i.e., till 11.10.2026, on or before which date the Petitioner undertakes to vacate the premises in question and hand over the vacant and peaceful possession of the same to the Respondent. The Petitioner, who appears in person, also consents to the aforesaid arrangement.
5. Let an Affidavit of Undertaking to this effect be filed within a period of one (01) week from today, failing which the Petitioner shall vacate the premises forthwith.
6. The Registry is directed to take the said Affidavit of Undertaking on record.
7. The parties are also ad idem that the aforesaid occupation of the premises by the Petitioner shall be without payment of any rent or use and occupation charges.
8. In view of the aforesaid submissions and undertaking, the warrant of possession issued against the Petitioner by the learned Executing Court, i.e., the learned ACJ/CCJ/ARC, North West District, Rohini Courts, Delhi, vide Order dated 03.08.2026, shall remain stayed and shall not be executed till 11.10.2026.
9. In view of the aforesaid undertaking given by the Petitioner, no further orders are required to be passed in the present Petition. This is a digitally signed order.
