The petitioner has approached this Court praying for a direction upon the Thika Controller to issue rent challans in favour of the petitoner no.1 in respect of Premises No. 8/1/1, Gurudas Dutta Garden Lane. The learned Advocate appearing for the respondent nos. 10 and 11 submits that the order of Thika Controller, Kolkata Thika Tenancy dated 26th April, 2023 is under challenge at the instance of the said respondents before the West Bengal Land Reforms and Tenancy Tribunal. The learned Advocate appearing for the State raises an objection as to the maintainability of this writ petition as an alternative and efficacious remedy is available under the West Bengal Land Reforms and Tenancy Tribunal. The petitioner has alleged inaction and/or culpable negligence on the part of the authority under the West Bengal Thika Tenancy (Acquisition and Requisition) Act, 2001 which is a specified Act under Section 2(r)(vii) of the West Bengal Land Reforms and Tenancy Tribunal Act, 1997. That apart, an application at the instance of the respondent nos. 10 and 11 is also pending before the learned Tribunal. Faced with such situation, the learned Advocate for the petitioners prays for leave to withdraw this writ petition with liberty to approach the learned Tribunal for appropriate relief. In the light of the submission made by the learned Advocate for the petitioners, WPA 7033 of 2026 stands dismissed as withdrawn with liberty as sought for by the learned Advocate for the petitioners.
