N CHANDRA SEKHAR REDDY Counsel for the Respondent/complainant: 1. PUBLIC PROSECUTOR 2 The Court made the following: ORDER: This instant Criminal Petition is filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, by the Petitioner/A.1, to grant anticipatory bail to him in the event of his arrest in connection with Crime No.93 of 2025 of Tadipatri Rural Police Station, Anantapur District, registered for the offences punishable under Sections 126(2), 118(1) read with 3(5) of BNS, 2023. The case of prosecution is that on the date of incident i.e., on 07.05.2025 at about 5.00 p.m. while the complainant was proceeding in his motor-cycle towards Little Flower Street from his house, the Accused Nos.1 and 2 came in a car and wrongfully restrained the complainant, abused him in filthy language and beat him with stone on his head and caused bleeding injury on his head. Complainant was shifted to Government Hospital, Tadipatri for treatment. Based on the complaint given by the Complainant, the present Crime is registered against Accused Nos.1 and 2. Heard Sri N.Chandra Sekhar Reddy, learned counsel for the Petitioner and Ms.K.Priyanka Lakshmi, learned Assistant Public Prosecutor for respondent State. Perused the material on record. Learned counsel for the Petitioner would submit that the Petitioner herein is arrayed as A.1 in the above Crime and that he is falsely implicated and he is innocent of the offence. Learned counsel would further submit that prima facie there is no incriminating evidence against him attracting the offences lodged against him. Learned counsel requested to grant anticipatory bail to the Petitioner in event of his arrest. 3 Learned Assistant Public Prosecutor would submit that there are specific allegations made against the Petitioner and investigation is not yet completed and prays for dismissal of the Petition. Considering the submissions and a fair look at the material on record, as rightly put by learned Assistant Public Prosecutor, the crime is under investigation and specific overtacts are attributed against the Petitioner, it is not the stage to grant anticipatory bail to the petitioner. At this juncture, learned counsel for the petitioner restricted the prayer to grant liberty to the Petitioner to surrender before the concerned Magistrate Court and to move regular bail petition. Learned Assistant Public Prosecutor would submit that the Court may pass appropriate orders. Considering the submissions made, liberty is granted to the Petitioner to surrender before the concerned Magistrate Court within two weeks and move a regular bail petition. On filing of such bail petition, the concerned Court is directed to pass appropriate orders according to law, as expeditiously as possible. Accordingly, this Criminal Petition is disposed of. Pending applications, if any, shall stands closed. Dr.JUSTICE VENKATA JYOTHIRMAI PRATAPA 28.01.2026 Mjl/* 4 HON’BLE DR.
