Learned counsel appearing on behalf of the petitioner submits that, other than the statement of a co-accused, there are no other incriminating materials available against the present petitioner.
Learned counsel appearing on behalf of the State relies on the report, which is taken on record, and the case diary and opposes the prayer for anticipatory bail. He submits that in addition to the statement of a co-accused, there are phone call records between the petitioner and the principal accused, including during the relevant period. Considering the above and the other incriminating materials available in the case diary and the restriction contained in Section 37 of the NDPS Act, I do not consider this to be a fit case for granting anticipatory bail. The application for anticipatory bail is, thus, rejected. Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities.
