JUSTICE JASMEET SINGH O R D E R % 11.08.2026 1. This is a writ petition filed under Article 226 of the Constitution of India seeking the following prayers :- “A. Issue a writ/order/direction in the nature of Mandamus directing the Respondents to permit the Petitioners to undertake the Presentation/Viva for the subject of “Major Project” of the Mid-Sem Exam of the Final Semester; B. Direct the Respondents to evaluate the Petitioners and declare their results; C. Direct the Respondents not to treat the Petitioners as detained pending completion of the aforesaid exercise;…” 2. The brief facts of the case are that the petitioners are students enrolled in the Course of MBA and are in their final semester. The petitioners This is a digitally signed order. They are facing detention only on the ground that they missed the single component of internal assessment, namely a Mid-Semester Presentation/Viva for the subject of “Major Project” conducted on 02.03.2026, which is one of the four MBA Final Semester subjects. 3. The petitioner No. 1 was unable to appear for the said internal component owing to the death of his maternal uncle and petitioner No. 2 could not appear owing to his internship. 4. As a result of this inability to appear in the viva on 02.03.2026, the petitioners have been unable to complete their course and graduate along with their batch mates. 5. Dr. Naval Garg, Associate Professor at the respondent University, who joins through video conferencing mode, states that the respondent University have a chock-a-block schedule and it is difficult to accommodate a Mid-Semester Presentation/Viva for the subject of Major Project in the hectic schedule of respondent university. 6. However, I am of the view that the petitioners have missed a Mid-Semester Presentation/Viva and the same is to be evaluated by the internal faculty of the respondent university. The respondent university does not have to take extra special steps, such as constituting a committee, calling external examiners etc to conduct the said internal component. Thus, I am of the view that the petitioners can be accommodated. 7. However, while stating so, this Court is also conscious that it is unaware of the workload of the respondent university and cannot issue This is a digitally signed order. Suffice it to say at this stage, that the respondent shall endeavor to accommodate the petitioners and conduct a Mid-Semester Presentation/Viva for the petitioners so that the petitioners can graduate along with their batchmates. 9.
