JUSTICE R.K. PATTANAIK Order No. ORDER 05.05.2026 03. 1. Heard learned counsel for the petitioner and State. 2. Instant petition has been filed under Section 482 BNSS by the petitioner seeking pre-arrest bail in connection with CID & CB P.S. Case No.4 of 2025 corresponding to G.R. Case No.537 of 2025 pending in the file of learned J.M.F.C.-III, Cuttack on the grounds stated. 3. Perused the FIR as at Annexure-1. This Court by order dated 21st April, 2026 directed the State to take instructions as to if the petitioner is co-operating the IO in the investigation. Today, it is informed to the Court by Mr. Dash, learned counsel for the petitioner that the accused appeared before the IO pursuant to the Court’s above order. Learned counsel for the State however submits that even though the petitioner appeared but is not extending co-operation in revealing the details of the case and who else involved in the preparation of fake certificates. The petitioner joined in service in 2000 and presently working as a Lecturer (Logic) in Tapoban (Junior) Higher Secondary School, Kuninda, Dhenkanal. The document submitted by the petitioner is found to have been forged and detected as a result. It is claimed that with after a proper verification at the time of joining of service, the document was accepted from the petitioner, but subsequently, it is alleged to be fake. Considering the above facts and since the petitioner is working as a Lecture and has already appeared before the IO for the purpose of investigation and also facing departmental enquiry, this Court is inclined direct him to surrender before the learned court below for being released with conditions even though not inclined to entertain his bail plea as is advanced. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL is disposed of with the direction as aforesaid. It is further directed that in the event, the petitioner surrenders before the court of learned J.M.F.C.-III, Cuttack in connection with CID & CB P.S. Case No.4 of 2025 corresponding to G.R. Case No.537 of 2025 within a fortnight from today, he shall be released on bail upon furnishing a bail bond of Rs.20,000/-(rupees twenty thousand) with one solvent surety for the like amount with such other conditions imposed besides the following, such as, he shall continue co-operating the IO in the investigation without fail till the same is over. 6. 6.
