JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners are before this Court calling in question the registration of a crime in Crime No.206/2025, registered for offences punishable under Section 2(a) of the Prevention of Destruction and Loss of Property Act, 1981, and Sections 270, 324(5), 351(2) read with 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Section 25(1B)(b) of Arms Act. 2. Heard Sri.Rajashekara R.V., learned counsel appearing for the petitioners, Sri.B.N.Jagadeesha, learned Addl. SPP appearing for respondent No.1, Sri.Muthu D.L., learned counsel appearing for respondent No.2 and have perused the material on record. - 4 - HC-KAR NC: 2026:KHC:9875 CRL.P No. 12124 of 2025 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a joint affidavit in that regard. The joint affidavit reads as follows: "We, Sri. Somashekar @ Soma. S/o Narayanappa, C, Aged about 35 years, R/at No.434, /9, Subbaiah Garden Lay out, Ist Main, 7th Cross, Hongasandra, Bengaluru- 560 068. 2. Sri. Mariya Sri. Raj, S/o late. Joseph, Aged about 34 years, R/at No.402, 15th cross, 13th Main, Venkateshwara layout, Madivala, Bengaluru-560068. 3. Sri. Arun.L, S/o Lakshmana, Aged about 22 years, C/o Krishnappa Building, 1st Main, 7th cross, Subbaiah Garden, Hongasandra, Bengaluru-560068. 4. Sri. Sathish Kumar, S/o Gopinath, Aged about 23 years, C/o Roopesh's rented House, Near Rajarajeshwari temple, 5th Cross, 1st Main, MSR Layout, Hongasandra, Bengaluru-560068. and Sri, Sridhar, S/o Venkateshappa, Aged about 35 years, C/o Suresh Rented House, R/at No.29/30, 7th Cross, Near Ganesh Temple, Oni Road, Hongasandra, Bengaluru-560 068. Do hereby solemnly affirm and state on oath as follows:- 1. We are the accused persons No.1 to 4. 2. The Respondent No.2 is the Complainant in Crime No.206/2025, wherein FIR has been filed under section 270, 324, (5) 351(2) R/w 3(5) of B N S-2023, and section 2 (a) PDLP Act 1981, and section 25 (1B) (b) of Arms Act. Against the accused No.1 to 4./Petitioners. 3. We state that all the petitioners and 2nd Respondent respectively in the above case and we are well conversant with the facts of the case. Hence, we are swearing to this affidavit. 4. We submit that in view of the intervention of respectable persons of the Bar it has been resolved to withdraw the above case and on the advice of the said persons and at the instance of elders, well wishers and friends we have amicably settled the matter amongst ourselves and do not intend to precipitate the matter - 5 - HC-KAR NC: 2026:KHC:9875 CRL.P No. 12124 of 2025 further, as such we have amicably decided to close the matter to the following conditions:- a. We are agree if any cases/complaints pending before any courts/authorities filed against other shall be withdrawn in terms of this settlement. b. We are also agree withdraw all the allegation made against respondent and other either in this petitioners in connected cases or orally and there is no undue influence, force, or coercion in entering into this agreement from anyone or anything. WHEREFORE, We most humbly pray that this Hon'ble Court may be pleased allow the above petition FIR (in Cr. No.206/2015, Bommanahalli police, pending on the file of learned Chief Judicial Magistrate At Bengaluru, under section 270, 324,(5) 351(2) R/w 3(5) of BNS-2023, and section 2 (a) PDLP Act 1981, and section 25 (1B) (b) of Arms Act. Against the accused No.1 to 4./Petitioners. What is stated above is true to the best of our knowledge, belief and information." 4. In the light of joint affidavit having being filed and offences not being against the State, I deem it appropriate to accept the joint affidavit and terminate the proceedings against the petitioners in the subject petition. 5.
