1. Petitioners seek quashing of case FIR No. 136/2023 of PS Badarpur for offence under Section 498A/406/34 IPC on the ground that the complainant de facto (respondent no.2) has compromised the disputes with the petitioners and now they are living together. 2. Learned APP for the State assisted by IO/SI Mahesh Chand accepts notice and submits that State has no objection to this petition. 3. Page 2 of 2 pages accepts notice. 4. I have spoken with respondent no. 2 in Hindi and it is stated by her that now she has settled all her disputes with the petitioners. It is stated by her that for past about 2½ years, she is living with the petitioners happily. It is also stated by her that from her wedlock with petitioner no. 1, one son was born earlier and now recently she has given birth to another son, both of whom are living with her and the petitioners. The respondent no. 2 specifically submits that she does not wish to continue prosecution of the petitioners because now they are living together. 5. Having spoken with respondent no. 2, I am satisfied that it would in the interest of justice not to push them through full dress trial. Therefore, the present petition and the accompanying application are allowed and consequently, the FIR No. 136/2023 of PS Badarpur for offence under Section 498A/406/34 IPC as well as proceedings arising out the same are quashed.
