By virtue of the present application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the applicant seeks grant of regular bail in proceedings arising out of FIR No.62/2021 dated 26.03.2021 registered at PS.: Anand Parbat under Sections 302/323/506/201/34 of the Indian Penal Code, 1860 (IPC).
2. Briefly put, as per FIR, in the evening of 25.03.2021 the applicant threatened the complainant over the issue of urination. said issue, an altercation ensued wherein the applicant, along with other co-accused persons, assaulted the complainant and his family member. Thereafter, when the father of the complainant intervened to save his family, the applicant and co-accused Mohd. Javed caught hold of him and co-accused Ram Kalyan stabbed him with a knife causing his death.

In these facts, this Court has heard learned counsel for the petitioner and learned APP, with support from learned counsel for the kith and kins of the deceased, and also gone through the materials on record, including the written synopsis handed over by learned counsel for the kith and kins of the deceased, which is taken on record.

Facts herein disclose that on one hand the only role assigned to the applicant is that he was holding hands of the deceased whence another co- accused stabbed him, leading to his eventual death, and that as per the Nominal Roll received his conduct while inside the jail has been ‘Unsatisfactory’. However, they both have to be cumulatively seen alongwith various other factors like [i] at the time of incident he was aged less than 20 years old and presently also he is only a young 24-year-old boy with no prior criminal antecedents; [ii] he has already undergone around more than five years in custody for his alleged role; and [iii] as on date only eighteen (18) out of total of twenty-eight (28) have been examined so far, and it is likely that conclusion of trial will take some more time, as also all the material witnesses have already been examined and only formal witnesses remains to be examined. 5. Juxtaposing the above factors on one hand with the other various factors cumulatively, as also taking into account the existing facts and circumstances herein and since it is a case wherein the applicant’s right This is a digitally signed order. under Article 21 of the Constitution of India are effected, in the considered opinion of this Court the applicant is entitled for grant of a regular bail. 6. Accordingly, the present application is allowed and the applicant be released on regular bail in proceedings arising out of FIR No.62/2021 dated 26.03.2021 registered at PS.: Anand Parbat under Sections 302/323/506/201/34 of the IPC subject to him furnishing a personal bond in the sum of Rs.25,000/- [Rupees Twenty Five Thousand Only] along with one surety of the like amount by a family member/ friend having no criminal case pending against him/ her and subject to the satisfaction of the Trial Court, and further subject to the following conditions: i. The applicant shall ordinarily reside at his address as per the Prison Records, and in case of any change in the residential/ permanent address/ contact details/ phone number, the applicant shall inform the same to the IO concerned. ii.
ii. Applicant shall surrender his Passport, if any, to the IO concerned within three days of his release and shall join and participate in the investigation as and when called by the IO. iii. Applicant shall provide all his mobile numbers to the IO concerned which shall be kept in working condition at all times. v. The applicant shall also appear before the Court as and when the matter is taken up for hearing. vi. Applicant shall not indulge in any criminal activity and shall not contact any of the prosecution witnesses, or tamper with the evidence of the case. 7. A copy of this order be sent to the concerned Jail Superintendent for necessary information and compliance forthwith. This is a digitally signed order.
