Heard Mr. Vasant Zokarkar, appeared through virtual mode, learned counsel for the petitioner. Also heard Mr. Shaleen Singh Baghel, learned Govt. Advocate, appearing for the Respondent/State. 2. The present petition has been filed by the petitioner with the following prayer: "It is, therefore, most respectfully prayed that this Hon’ble Court may kindly be pleased to allow this ALOK SHARMA Digitally signed by ALOK SHARMA Date: 2026.01.13 11:23:04 +0530 2 petition and quash impugned First Information Report bearing FIR, bearing crime no. 100/2025 for the offences punishable under Section 420 of IPC and charge sheet bearing no. 129/2025, have been submitted by the Police Station Chirmiri, District – MCB (C.G.) before the Judicial Magistrate First Class Chirmiri, District – MCB (C.G.) against the petitioner, with entire criminal proceedings initiated in pursuance to impugned FIR, in the interest of justice." 3. At the time of hearing, this Court has observed that the petitioner has filed the present petition without filing and challenging order taking cognizance of the case. 4. In such a situation, learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to file a duly constituted petition. 5. Accordingly, the present petition is dismissed as withdrawn with the aforesaid liberty subject to depositing a sum of Rs.5,000/- as cost by the petitioner in the Registry of this Court within a period of one week from today and the said amount shall be transmitted to the Govt.
