JUSTICE SATYAVRAT VERMA ORAL ORDER 2 13-05-2026 1. Heard learned counsel for the petitioners and learned A.P.P. for the State. 2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 191(2), 190, 115(2), 352, 351(3) and 303(2) of the Bharatiya Nyaya Sanhita. Patna High Court CR. Learned counsel for the petitioners submits that petitioner nos. 1, 2, 4 and 8 have antecedent of two cases and petitioner nos. 3, 5, 6 and 7 are persons with clean antecedent and petitioner nos. 6 and 7 are women. It is also submitted that petitioner nos. 1, 2, 4, 8 earlier came to be implicated by the side of the informant only. It is next submitted that the informant alleges that the crops cultivated on his purchased land was illegally cut and looted by the petitioners on 29-11-2025 and when he reached at the place of the occurrence, he was chased away by the petitioners who were carrying lathi, axe and hoe, further the petitioners demanded an extortion of Rs. 5 lakh and Pania Devi disrobed the informant and threatened that he would be implicated in a false case of rape. 4. Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is next submitted that from perusal of the allegations as alleged in the FIR, it would manifest that on account of dispute relating to land, the occurrence is alleged to have taken place. It is further submitted that informant is claiming the land described in the FIR as his whereas the petitioners are claiming the land as their. It is also submitted that allegation of assault is general and omnibus in nature and in Patna High Court CR. MISC. No.32838 of 2026(2) dt.13-05-2026 3/3 order to give seriousness to the case, it is alleged that extortion was demanded. It is also submitted that if privilege of anticipatory bail is granted to the petitioners, the petitioners will not abscond rather will co-operate in the investigation to prove their innocence. 5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners. 6. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Sajour P.S. Case No. 2 of 2026, subject to the conditions as laid down under Section 482 (2) of the BNSS. Sumit/- (Satyavrat Verma, J) U T
