Mr. Bitasok Banerjee Mr. Debarshee Bramha. …for the State. Learned advocate appearing for the petitioner submits that the petitioner is in custody for 7 months. Charge-sheet has already been submitted and there are no materials collected to show that there has been any recovery from the petitioner and the petitioner has been implicated on the basis of statement of co- accused. On the other hand, learned advocate for the State opposes the prayer for bail and submits that there was continuous communication on the relevant date of incident between the present petitioner and one Nashim Rejvi and also between Nashim Rejvi and Samim Shekh. Be that as it may, the prosecution case is against the 2 petitioner for carrying out clandestine business. Learned advocate for the State has submitted the report of the nodal agency enclosing the compact disc. Having regard to the fact that the case is at the initial stage where dates are being fixed for supply of copies, some opportunity is granted to the prosecution for exercising their discretion if they intend to file supplementary charge-sheet. At this stage, the prayer for bail of the petitioner in CRM(NDPS)1169 of 2025 is rejected. The investigating officer of the case is present in Court. His further appearance before this Court is dispensed with. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
