Heard Mr. M. R. Sodial, learned counsel for the petitioner. Also heard Mr. D. Borah, learned Government Advocate, appearing on behalf of respondent No. 1; Mr. S. Sharma, learned counsel, appearing on behalf of respondents No. 2, 3 & 4; and Ms. Tinlung, learned counsel, appearing on behalf of Mr. R. K. Talukdar, learned standing counsel, Accountant General(A&E), Assam, appearing on behalf of respondent No. 5.
2. This writ petition has been filed by the petitioner for inclusion of the name of his wife i.e. Smti. Dipali Roy Dutta as a nominee in the Service Book of the petitioner for receiving the family pension in the event of his death.
3. Mr. Sodial, learned counsel for the petitioner, submits that the prayer made in the present writ petition has been substantially complied with by including the name of the wife of the petitioner in his Service Book for receiving family pension on account of the death of the pensioner. He, therefore, submits that this writ petition may be disposed of as having become infructuous.
4. The learned counsel for the respondents has no objection.
5. In view of the above, this writ petition stands disposed of as having become infructuous.
6. Interim order, if any, stands vacated.
