Heard Mr. A. Ali, learned counsel for the petitioner and Mr. K.K. Das, learned Additional P.P. for the State respondents. 2. Invoking section 483 BNSS, the petitioner herein is seeking regular bail in
Page No.# 2/3 connection with Barpeta PS Case No. 231/2026 under section 80(2) BNS. 3. The FIR dated 29.06.2026 was lodged by the father of the deceased woman naming the husband/accused No. 1 (petitioner herein) and 4 (four) other accused persons. The allegations is that the deceased woman was married to the accused No. 1 and subsequently, the accused persons named in the FIR started demanding several lakhs of rupees for dowry and inflicted physical and mental torture upon her. Eventually, due to the inability to meet the said demand, the victim woman is stated to have been killed by the accused persons by hanging her. 4. The present petitioner is stated to be the husband of the deceased who was arrested on 30.06.2026 and is presently in judicial custody. 5. An earlier bail petition was rejected on 24.08.2026 in Bail Appln. No. 2371/2026. 6. The updated case diary was called for and has been received. 7. Mr. K.K. Das, the learned Additional P.P. fairly submits that last endorsement in the case diary is on 24.07.2026. Thus, it appears that there has been no investigation after the last date of date of rejection on 24.08.2026. Meanwhile, the petitioner is stated to have completed 85 days in pre-trial detention. However, the learned Additional P.P., objecting to the bail, submits that the investigation has implicated the petitioner. 8. In the circumstances, the petitioner can be enlarged on bail at this stage, subject to suitable conditions.
The petitioner is allowed to go on bail of Rs.50,000/- with one surety of the like amount to the satisfaction of the learned CJM, Barpeta, subject to the following conditions:- (i) He shall cooperate with remaining investigation,

(iii) He shall not hamper or tamper with evidence, (iv) He shall not try to intimidate or influence witnesses and, (v) He shall not in any manner intimidate or harass the informant and their family members. 9. Violation of the bail conditions will lead to cancellation of the bail. 10. This bail application stands allowed and disposed of. 11. Send back the case diary. JUDGE
