1. This petition has been filed under Article 226 of the Constitution of India with following relief(s):
“10.1 That, Respondents Public servant committed the criminal misconduct in the discharge of their duty, are much learned and have knowledge of the consequences of such criminal misconduct should be prosecuted and convicted with the strongest punishment at law. 10.2 That, respondents are Public servant posted on the topmost offices of a government organisation having influence to manage any enquiry or investigation against them, therefore petitioner prays to convict the accused on evidence produced. 10.3 That this Hon'ble Court may kindly issue direction, or may kindly be pleased to grant any other ancillary relief by issuing any other suitable writ, direction or
order, deems fit in the facts and circumstances of the case including cost of petition.”
2. Petitioner in person has came up before this Court with above prayers/reliefs and his main grievance is that he has filed a writ petition (WPC No.4585/2022) before this Court, which was
disposed of on 05.07.2023 in which some directions were given by the learned Single Judge; he states that in the said proceedings certain documents have been filed by the respondents which was forged documents, hence, he prays that action would be taken against the said respondents; but as has
3 been claimed/stated by the petitioner in person that he was not aware about the fact that forged documents have been filed by the respondents at that relevant point of time when the writ petition (WPC No.4585/2022) was disposed of, however, he came to know about this fact subsequently, therefore, he has filed the present petition.

As per the provisions contained under the Cr.PC/BNS, as the case may be if any proceeding of the Court any documents have been filed which claimed to be a forged documents etc, then the remedy is available to take recourse to the law as per the Cr.PC/BNS as the case may be before the said Court only.
4. At this juncture, petitioner in person contended that he may be permitted to withdraw this petition with liberty to take recourse to the law as per the Cr.PC/BNS as the case may be.
5. In view of above, the instant petition is dismissed as withdrawn with aforesaid liberty. CC as per rules.
