THIS PEITTION COMING ON FOR CONCILIATION BEFORE NATIONAL LOK ADALAT, THE FOLLOWING CONCILIATION ORDER IS PASSED: CONCILIATION ORDER The cheque amount involved is Rs.10,00,000/-. The trial Court in C.C. No.29677/2017, vide judgment and order dated 23.04.2019 has imposed a fine of Rs.10,00,000/-. The appeal filed by the accused in Crl.A.No.1234/2019 is dismissed on 04.12.2021. The present petition is filed by the accused. 2. Both the parties, along with their respective counsel are present before the Court. It is jointly submitted that the parties have agreed to settle the dispute for a sum of Rs.5,00,000/- towards full and final settlement. 3 3. It is submitted that a sum of Rs.2,00,000/- has already been deposited before the trial Court. 4. The petitioner submits that, along with the cheque in question, two cheques were issued in favour of the respondent and a demand promissory note was also executed. He prays that the respondent be directed to return the said cheques and demand note. 5. The respondent is present and fairly submits that he is not in possession of any cheques issued by the petitioner, similarly, he is not in possession of any demand promissory notes. 6. The statements made by both parties are taken on record. 7. Learned counsel for the petitioner submits that, out of the remaining amount of Rs.3,00,000/-, a sum of Rs.2,00,000/- shall be paid on or before end of March, 2026 and seeks time till the end of May, 2026 for payment of the remaining Rs.1,00,000/-. 4 8. Learned counsel for the respondent, on instructions, confirms the settlement. However, he submits that the entire amount be paid before end of March, 2026. 9. The respondent further seeks an order for release of the amount already deposited. 10. In view of the settlement, the following order is passed: i. Revision petition stands disposed of in view of the settlement arrived between the parties. ii. The order of the trial Court in C.C.No.29677/2017 dated 23.04.2019 is modified, and the fine is reduced to Rs.5,00,000/-. iii. The respondent is at liberty to withdraw sum of Rs.2,00,000/- deposited before the trial Court. 5 iv. The trial Court is directed to release the said amount in favour of the respondent through electronic transfer upon due identification. v. The petitioner shall pay a sum of Rs.2,00,000/- on or before 31st March 2026 and the remaining Rs.1,00,000/- on or before 30th April 2026. vi. Liberty is reserved in favour of the respondent to revive this petition in the event of failure by the petitioner to pay the agreed amount of Rs.3,00,000/- within the time stipulated above.
