BEFORE HONOURABLE MR. JUSTICE SANJAY KUMAR MEDHI ORDER 23.09.2026 Heard Shri D. Borah, learned counsel for the petitioner. Also heard Shri A. Sarma, learned Standing Counsel, OIL. The instant petition under Article 226 of the Constitution of India has been filed against a notice of termination dated 02.09.2026 issued by the respondent no. 7. Page No.# 3/3 It is the case of the petitioner that service contract was awarded to the petitioner for the period from 30.10.2023 to 30.10.2027. While Shri Borah, the learned counsel has urged the grounds that such termination is arbitrary, illegal and in violation of the principles of natural justice, Shri Sarma, the learned counsel for the OIL has raised a preliminary objection on the maintainability of the writ petition. He has submitted that respondent no. 7 is a private entity and the contract of the petitioner with the respondent no.
7 is a private contract. He has submitted that OIL whom he represents has no role in the contract or its termination made by the respondent no. 7. On a perusal of the materials of the writ petition and the documents enclosed would make it clear that the dispute of the petitioner is against the respondent no. 7 with whom there was a contract and the impugned action is of the termination order dated 02.09.2026. At this stage, Shri Borah, the learned counsel for the petitioner has also submitted that there is an arbitration clause. In view of the aforesaid discussion, the instant writ petition is held to be not maintainable and is accordingly dismissed. Dismissal of the writ petition shall not be a bar for the petitioner to approach the appropriate forum for redressal of his grievance in accordance with law. JUDGE Comparing Assistant
