The petitioner has filled this petition seeking the following reliefs:- “10.1 That, this Hon'ble Court may kindly be pleased to quash/set-aside the impugned promotion order dated 26/12/2025 issued by the Respondent No. 2. BALRAM PRASAD DEWANGAN Digitally signed by BALRAM PRASAD DEWANGAN 2 10.2 That, this Hon'ble Court may kindly be pleased to direct the Respondent authorities to correct the impugned gradation list issued on 06/11/2024 changing the absorption date, seniority date and date of birth of the petitioneror prepare and finalize gradation list afresh, after granting opportunity of objection/hearing to the petitioners. 10.3 That, the respondent No.1 and 2 be directed to consider the case of the petitioner for promotion to the post of Lecturer (Maths/Physics) and grant him promotion in the same DPC conducted on 22.12.2025, convened for the promotion order dated 26.12.2025 or review DPC be convened and petitioner be granted promotion. 10.4 That, this Hon'ble Court may further be pleased to grant such other relief(s) as may be deemed fit and proper in the interest of justice and fair play. 2. Learned counsel for petitioner submits that petitioner was initially the employee of school run by local body and holding the post of teacher. Pursuant to the policy decision taken by State Government all schools were taken over by the School Education Department and the employees, who have completed 8 years of their service from the date of their appointment and employed by the local body and tribal department were also absorbed. They were accordingly placed in the gradation list of teachers LB and teacher (T). Gradation list was published on 01.04.2023 in which petitioner has been placed much below in the gradation list than to his entitlement. She submits that name of petitioner is mentioned in the Sr. No.14229 and in the gradation list date of birth, and date of absorption is being erroneously mentioned, due to which, petitioner has been placed below in the gradation list. She contended that respondents authorities have 3 initiated proceedings of promotion and have issued an order of promotion on 26.12.2025, which revealed that respondent No.5, who was junior to petitioner has been promoted on the post of Lecturer. She further contended that before initiating proceedings of promotion, representation submitted by petitioner on 24.07.2024 was not considered and decided. She further contended that representation was submitted by petitioner within time, however, due to non- consideration of representation by the authorities within time, petitioner is made to suffer. 3. Learned State counsel submits that looking to the nature of grievance as raised in the writ petition, for which petitioner has already submitted representation, it will be considered and appropriate orders will be passed in accordance with law. 4. I have heard learned counsel for parties and perused the documents placed on record. 5. Taking into consideration submission of learned counsel for respective parties and the facts and circumstances of the case, nature of grievance raised in this petition, that there is some typographical error in mentioning the date of birth of petitioner as also date of joining and date of absorption, which can be corrected after perusal of the records by the department itself, I find it appropriate to dispose of this writ petition at this stage directing respondent No.3 and 4 to consider and take decision on the representation of petitioner pending before them in accordance with law expeditiously within further period of four weeks from the date of receipt of order. Petitioner will be at liberty to submit fresh representation before the respondents No.3, if he so 4 desire and if such representation is submitted, same shall also be considered and decided as observed above. If claim of petitioner is found to be correct and the authorities comes to the conclusion that petitioner is to be placed above in the gradation list, then appropriate decision be taken and orders be passed on the claim of promotion of petitioner. 6.
