Counsel appearing on behalf of the respondents no.1 and 2 has drawn the attention of the Court to Section 3 (7) of the Delhi Medical Council Act, 1997 (the ‘DMC Act’), which is set out below: “3. Constitution, functions and powers of the Council.– Constitution and incorporation of the Council – … (7) Where any dispute arises regarding any election of a member or of the President or Vice-President, it shall be referred to the Government, and the decision of the Government shall be final.” 4. Counsel for the respondents no.1 and 2 submits that in the present case, no reference has been made to the Government with regard to the election results of the Delhi Medical Council dated 1st June, 2026. 5. Counsel for the petitioner submits that he is willing to make a reference to the respondent no.1/GNCTD with regard to the disputes raised by him. 5.1 He further submits that that the present writ petition may be treated as a reference under Section 3 (7) of the DMC Act. Accordingly, the present writ petition is disposed of while directing the respondent no.1/GNCTD to treat the present writ petition as a representation/reference under Section 3(7) of the DMC Act and take a decision on the said representation within four (4) weeks from today. 6.1. The petitioner shall be granted a hearing before passing an order on the said representation. 7. Records of the election shall be preserved by the respondents. 8.
