Alam, learned counsel for the applicant. Also heard the learned Additional Public Prosecutor appearing for the State. This Interlocutory Application has been preferred seeking suspension of the sentence of 10 years and a fine of Rs.20,000/- i/d SI for two months pursuant to the conviction of the petitioner under Section 376 IPC. Page No.# 2/2 The learned counsel for the petitioner submits that the victim girl had unfortunately expired before her evidence could be recorded and there is no other eye witness to the alleged occurrence. The fact of expiry of the victim girl before her evidence could be recorded is not disputed. On perusal of the impugned judgment, it appears that the learned Court below has stated the statement of the victim recorded under Section 164 Cr.P.C. as substantive evidence and the conviction appears to be based primarily on the same statement. Objection filed by the prosecution has been perused. Upon hearing the learned counsel for the applicant as well as the learned Additional Public Prosecutor, I deem it fit to suspend the reminder of the sentence till disposal of the connected appeal. Accordingly, the judgment dated 27.03.2026 passed by the learned Special Judge, Udalguri in Spl. (POCSO) Case No.123/2024 convicting the accused/petitioner under Section 376 IPC to undergo Rigorous Imprisonment for 10 years and to pay fine of Rs.20,000/- shall stand suspended. I.A. stands disposed of. JUDGE Comparing Assistant
