Heard Sri Mushir Khan, learned counsel for the petitioners and Sri Ajay Singh, learned A.G.A.-I for the State and perused the material on record. 3. This matter is nominated to this Bench vide order dated 03.09.2026 by Hon'ble The Chief Justice. 4. The present petition under Article 227 of the Constitution of India has been filed by the petitioners- Ramesh Singh and Suresh Singh, with the following prayer:- "It is therefore most respectfully prayed from the Hon'ble High Court that may graciously be pleased to stay the effect and operation of the impugned order dated 10.08.2026 passed by Chief Judicial Magistrate, Farrukhabad in Misc. Case No.1448/2026 (Mahesh Verma Vs. Munna Khan and others), Under section 173 (4) B.N.S.S. by which application filed u/s 173(4) BNSS filed by respondent no.4 was allowed and officer incharge of P.S. Shamshabad was directed to register the case and investigate the same, during the pendency of the present petition before this Hon'ble Court otherwise petitioners shall suffer irreparable loss and injury and/or may pass such other and further order as this Hon'ble Court may deem fit and proper." 5. Learned counsel for the petitioners submits that as per his instructions a first information report in the matter has been lodged and the impugned order dated 10.08.2026 passed by the Chief Judicial Magistrate, Farrukhabad has been complied with. He submits that the present petition for writ be dismissed as not pressed as he shall be seeking the appropriate remedy available to him under law. 6. Prayer is allowed. 7.
