Learned Additional Government Advocate raises a preliminary objection that the petitioner is questioning the mutation entries in the RTC on the ground that the entries are illegal entries. Such a petition cannot be entertained by this Court. Learned Additional Government Advocate therefore submits that the petitioner may be directed to approach the appellate authority to redress his grievance. 3. Learned counsel for the petitioner although admits that it is stated in the petition that the entries in the RTCs are illegal, nevertheless, submits that since fraud has been practised on the petitioner the petitioner has directly approached this Court. 4. Having heard the learned counsel for the petitioner and the learned Additional Government Advocate, this Court is of the considered opinion that the submissions made by the learned Additional Government Advocate is to be accepted. When there is an efficacious - 4 - HC-KAR NC: 2026:KHC:7030 WP No. 39543 of 2025 remedy available for the petitioner and that too before a fact finding authority, such a writ petition cannot be entertained. 5. Accordingly, while disposing of the writ petition liberty is reserved to the petitioner to approach the competent authority to redress his grievance. Ordered accordingly. 6.
