Learned counsel for the petitioner would submit that, all the issues have been decided in favour of the petitioner, however, only on the point of sanction for prosecution, the accused persons have been acquitted. The issue involved consideration with respect to the necessity of proper sanction and there are sufficient material with respect to the alleged offence committed by the accused persons. On due consideration, the application is allowed. The petitioner is granted leave to appeal. Registry is directed to register the present CRMP as an acquittal appeal and list it in the next week.
