Criminal Miscellaneous Bail Application No. 311/2026 Hariom S/o Suresh, Aged About 28 Years, R/o Atroli Police Station Diholi District Dholpur. (Accused Petitioner Is In Judicial Custody In District Jail Dholpur). ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Neeraj Sharma (SB CRLMB No.218/2026) Mr. Sumit Kumar Jain with Mr. Dhananjay Jain (SB CRLMB No.311/2026) For Respondent(s) : Mr. Vivek Sharma, PP HON'BLE MR. JUSTICE SANDEEP TANEJA Order 16/02/2026 1. The present bail applications have been filed by the accused- petitioners under Section 483 of B.N.S.S. in connection with F.I.R. No.540/2025 registered at Police Station Kotwali Dholpur, District Dholpur, for the offence(s) punishable under Section(s) 319(2), 318(4), 338, 336(3), 340(2) & 61(2)(a) of B.N.S and Sections 3, 4, 6, 7 & 10 of the Rajasthan Public Examination (Prevention of Unfair Means) Act, 1992. [2026:RJ-JP:7234] (2 of 3) [CRLMB-218/2026] 2. Learned counsel for the petitioners submit that the accused- petitioners have been falsely implicated in the case and they have nothing to do with the alleged offences. Learned counsel further submit that the examination in question is not a competitive examination, therefore, no wrongful gain or loss has been caused to any person. Learned counsel also submit that the petitioners have no criminal antecedent; they are in custody since long and no recovery is required to be made from them. Learned counsel further submit that the case is triable by a Court of Magistrate; charge-sheet has already been filed in the matter and trial will take considerably long time in its conclusion, so no fruitful purpose would be served by keeping the petitioners in custody, therefore, the benefit of bail under Section 483 B.N.S.S. may be granted to the accused-petitioners. 3. Per contra, learned Public Prosecutor opposes the submissions made by learned counsel for the petitioners hereinabove. 4. Taking into consideration the overall facts and circumstances of the case; considering the arguments advanced by learned counsel for the petitioners, the fact that the case is triable by a Court of Magistrate, charge-sheet has already been filed and trial will take considerably long time to conclude, thus, without commenting anything on the merits / demerits of the case, this Court deems it just and proper to enlarge the petitioners on bail. 5. Therefore, the bail applications under Section 483 B.N.S.S. are allowed and the accused-petitioners, namely Sholu Kuntal S/o Shri Rajkumar and Hariom S/o Suresh, are ordered to be [2026:RJ-JP:7234] (3 of 3) [CRLMB-218/2026] released on bail, provided each of them furnishes a personal bond in the sum of Rs.1,00,000/- with two sureties of Rs.50,000/- each to the satisfaction of the Trial Court, with the stipulation that the petitioners shall appear before that Court on all subsequent dates of hearing and as and when they are called upon to do so.
