JUSTICE D K SINGH) The present intra Court appeal has been filed impugning the judgment and order dated 14.11.2025 passed by the learned Single Judge in W.P.No.17927/2025 (S-RES), preferred by respondents herein. 2. The parties are referred to as per their ranking before the writ Court, for the sake of convenience. 3. The appellant/respondent before the writ Court was working as a Lecturer w.e.f. 23.05.2005 in Life Sciences at J.C. Road Campus of the petitioner's Institution. The termination - 3 - HC-KAR NC: 2026:KHC:15166-DB WA No. 2113 of 2025 notice dated 29.01.2024 came to be issued by the petitioners against the respondent. 4. The respondent being aggrieved by the order of termination preferred an appeal in MA (EAT) No.5/2024 before the Educational Appellate Tribunal along with I.A.No.1/2024 seeking stay of operation and execution of the termination notice. 5. The Educational Appellate Tribunal vide order dated 02.05.2025 allowed the application and stayed the operation and execution of termination notice dated 29.01.2024, after more than one and half years. 6. The learned Single Judge having considered the law laid down in several judgments that at the interim stage, final relief should not be granted, has set aside the order dated 02.05.2025 passed by the petitioners in M.A (EAT) No.5/2024. 7. We find no reason to take a different view than taken by the learned Single Judge inasmuch as the Educational Appellate Tribunal has granted stay of the operation of termination notice - 4 - HC-KAR NC: 2026:KHC:15166-DB WA No. 2113 of 2025 dated 29.01.2024 at the initial stage itself and virtually the appeal has been decided by the interim order. 8. We therefore, do not interfere with the impugned judgment and order dated 14.11.2025, hence the appeal is dismissed. However, we direct the Educational Appellate Tribunal to decide the pending Appeal in M.A (EAT) No.5/2024 expeditiously preferably within a period of three months in accordance with law. 9. In view dismissal of the appeal, pending interlocutory applications, if any, do not survive for consideration hence stand disposed of.
