Learned counsel for appellant submits that this appeal has been filed at this stage, primarily for modification of order dated 01.12.2023, to the extent of the observation that petitioner shall not be entitled for any commission on deposits made by her, should be deleted at this stage, as it is difficult for appellant to make two ends meet.
2. Reply to a query posed by this Court as to whether any application for modification has been filed by appellant, is in negative.
3. Keeping in view the same, learned counsel for appellant submits that this appeal as well as Interlocutory Application seeking condonation of delay, may be permitted to be withdrawn, with liberty to file an appropriate
HCJ & RRRJ WA_524_2026 application before learned Single Judge seeking modification of order by bringing to notice of Court, the specific circumstances of appellant as of now.
4. I.A.No.1 of 2026 in/and this Writ Appeal are accordingly dismissed as withdrawn with liberty as aforementioned, without expression of any opinion on merits of the matter. No costs. Pending miscellaneous applications, if any, shall stand closed.
