JUSTICE SANDEEP TANEJA
Order 05/02/2026
1. The present bail application has been filed by the accused- petitioners under Section 483 of B.N.S.S. in connection with F.I.R. No.170/2023 registered at Police Station Fatehpur Kotwali, District Sikar for the offence(s) punishable under Section(s) 398, 394, 307, 395 r/w Section(s) 34 & 120-B of IPC and Section(s) 3/25 of the Arms Act.
2.
Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case and has nothing to do with the alleged offences. Learned counsel further submits that the petitioner is in custody since 27.11.2025; Test Identification parade has not been conducted and no recovery is required to be made from the petitioner, so no fruitful purpose would be served by keeping him into custody. Learned counsel also submits that vide order dated 09.10.2023, a Co-ordinate Bench of this Court
[2026:RJ-JP:5498] (2 of 2) [CRLMB-355/2026] has already granted bail to co-accused, namely Nayum Khokar S/o Abdul Rahman in S.B. Criminal Miscellaneous Bail Application No.12429/2023, and therefore, prays to grant bail to the petitioner on ground of parity.
3. Learned Public Prosecutor vehemently opposes the instant bail application and submits that the petitioner has four criminal antecedents, however, out of which he has already been acquitted in one case, so as of now three criminal cases are pending against him.
4. Heard learned counsel for both the parties and perused the material available on record.
5. Taking into consideration the overall facts & circumstances of the case; the arguments advanced by learned counsel for the petitioner, the fact that a co-accused has already been granted bail by a Co-ordinate Bench of this Court and trial is likely to take considerable time in its conclusion, without commenting anything upon the merits / demerits of the case, this Court deems it just and proper to enlarge the petitioner on bail.
6. Therefore, the bail application under Section 483 B.N.S.S. is allowed and the accused-petitioner, namely Sandeep @ Dholiya S/o Surendra Kumar, is ordered to be released on bail, provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the trial Court, with the stipulation that the petitioner shall appear before that Court on all subsequent dates of hearing and as and when he is called upon to do so.
