1 118-6594-24.odt IN THE HIGH COURT OF JUDICATURE AT BOMBAY NAGPUR BENCH AT NAGPUR WRIT PETITION NO. 6594/2024 Smt. Meetali w/o Virendra Mehta Vs. Deputy Director of Education, Nagpur Division and another Office Notes, Office Memoranda of Coram, Appearances, Court's orders or directions and Registrar's orders Court's or Judge's orders Mr. P.N. Shende, Advocate for petitioner Mr. N.R. Patil, AGP for Respondent No.1 CORAM: ANIL L. PANSARE, AND NIVEDITA P. MEHTA, JJ. DATED : 06.10.2026 1. On 14th November, 2024, following order was passed. “At the request made by the learned Counsel for Petitioner, stand over to 28th November, 2024. 2. On the next date, the Petitioner shall address the Court as to how the Writ Petition can be maintained by the Court after lapse of time period of nine years from the date of passing the impugned order.” 2. In view of the aforesaid order, the learned Counsel for the Petitioner was specifically called upon to explain the delay of nearly nine years in assailing the impugned order. However, despite the specific opportunity granted by this Court, no satisfactory explanation has been tendered for such inordinate delay. The Petitioner has neither addressed the Court on the aspect of delay nor placed on record any material explaining the circumstances which prevented the Petitioner from approaching this Court within a reasonable period. 2 118-6594-24.odt 3. In the circumstances, we are of the considered view that the present Writ Petition suffers from gross delay and laches. The Petitioner having failed to satisfactorily explain the delay of nearly nine years, we are not inclined to exercise our discretionary jurisdiction under Article 226 of the Constitution of India. 4. The Writ Petition is, therefore, dismissed on the ground of delay and laches. There shall be no order as to costs. (NIVEDITA P. MEHTA, J.) (ANIL L. PANSARE, J.) MP Deshpande Signed by: Mr. M.P.
