Petitioner herein seeks quashing of order dated 02.06.2026 whereby Ministry of Home Affairs has refused to concur with the decision of the Board regarding premature release of the petitioner. 2. According to petitioner, refusal is merely based on some apprehension expressed by CBI and, therefore, the impugned order is not sustainable. 3. Issue notice. 4. Mr. Amol Sinha, learned Additional Standing Counsel appears for respondent No.1 and accepts notice. Mr. Ripu Daman Bhardwaj, learned SPP, who has joined the proceedings through video conferencing, appears for respondent No.2 and accepts notice. They seek time to file reply. 5. Let reply be filed by next date of hearing with advance copy to opposite side. 6. Learned counsel for the petitioner submits that earlier a petition had been filed by them, which was registered as W.P.(CRL) 1393/2026 and the next date in the abovesaid matter is 09.10.2026. She, however, submits that limited request in the abovesaid petition was to give a direction to MHA to decide the matter expeditiously. She submits that since decision has already been taken, she would not press the abovesaid petition as it is rendered infructuous, albeit, she submits that the decision of MHA is completely arbitrary and not sustainable. 7. As per the request made by learned counsel for the petitioner, the abovesaid petition has also been taken up today and in view of the abovesaid This is a digitally signed order.
