The present writ petition has been filed for issuance of appropriate writ(s) / Order(s) / Direction(s), directing Respondent No.4 to immediately and forthwith decide the mutation case No.110(A)/2012-13 pending for adjudication before Respondent No.4 after remand vide order dated 10.03.2015 by Respondent No.3 in Mutation Appeal No.01/2013-14. 2. The petitioner is claiming right, title, interest and mutation on the basis of partition suit. 3. It has been submitted by the learned counsel for the petitioners that Mutation Case No.110(A)/2012-13 has been filed for mutation of land falling in their share but the same had been rejected by the original authority vide order dated 16.08.2012 and same has been challenged by the petitioners 2026:JHHC:3641 Page | 2 W.P. (C) No.615 of 2024 by filing a Mutation Appeal No.01 of 2013-14 which has been allowed by the appellate authority vide order dated 10.03.2015 and the matter was remanded to the original authority for passing fresh order in the mutation application as per the law. 4. Further, it has been stated that despite appellate authority’s order no decision has been taken till now by Respondent No.4 and the Mutation Case No.110(A)/2012-13 has been kept pending till date. 5. In that view of the matter, the present writ petition is hereby disposed of directing the Original Authority i.e. the Circle Officer, Rajnagar to decide the issue as early as possible after following due process of law and giving opportunity to all of the concerned persons.
