1. The writ application has been preferred challenging order dated 30th September, 2025 passed by the respondent no.2 in the appeal being Application No. PG-07/2024-E and decision/order dated 30th September, 2025 passed by the respondent No.2 in the appeal being Application No.PG-07/2024-E and decision/order dated 16th February, 2024 passed by the respondent no.3 in the application being Application No.56/2022/ALCR.
2. The said orders have been passed by the Controlling Authority and the Appellate Authority directing payment of gratuity to the respondent/workman herein.
3. The petitioner has challenged the said orders on the ground that the respondent/workman was dismissed from service on 26.08.2019 and challenging the said dismissal, the
2 respondent/workman has raised an industrial dispute which is pending as Reference No.06 of 2022 before the Central Government Industrial Tribunal-cum Labour Court, Asansol.
4. It appears that the dismissal of the respondent/workman was for providing false information regarding the name, father’s name etc. in connection with his employment as per provision of Clause no. 26.9 of Certified Standing Order applicable to the company.
5. Considering such facts and circumstances and the fact that a Reference in respect of the dismissal
order is pending before the Tribunal, the impugned
order passed by the Controlling Authority and the Appellate Authority be stayed till the disposal of the Reference Case No. 06 of 2022 by the Central Government Industrial Tribunal-cum Labour Court, Asansol.
6. The writ application stands disposed of.
7. Urgent photostat certified copy of this order, if applied for, be supplied to the parties after completion of all necessary formalities.
