The present petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as the 'BNSS') seeking quashing of FIR No. 949/2014, registered at Police Station Nand Nagri, Delhi, for the offences punishable under Sections 279 and 304A of the Indian Penal Code, 1860 (hereinafter referred to as the 'IPC'), along with all consequential proceedings arising therefrom, on the basis of an amicable settlement arrived at between the parties. 3. Issue notice. 4. Learned APP for the State accepts notice on behalf of the State. 5. The petitioner, Respondent No.2 (complainant) and Respondent Nos.3 This is a digitally signed order. Briefly stated, the present FIR came to be registered on the complaint of Respondent No.2 in respect of a road accident which occurred on 25.09.2014, wherein the minor son of Respondent Nos.3 and 4, aged about three years, sustained fatal injuries after being hit by a vehicle allegedly being driven by the petitioner. Upon completion of the investigation, a charge-sheet was filed and the matter is presently pending before the learned JMFC (Shahdara), Karkardooma Courts, Delhi. 7. Learned counsel for the petitioner submits that, with the intervention of family members, relatives and respectable members of the society, the parties have amicably resolved all their disputes and have executed a compromise deed. It is submitted that, in terms of the settlement, the petitioner has handed over Demand Draft No. 984760 for a sum of ₹3,00,000/- (Rupees Three Lakhs only) in favour of Respondent Nos.3 and 4 towards full and final settlement of all their claims. 8. The aforesaid Demand Draft has been handed over in Court today and Respondent Nos.3 and 4 acknowledge receipt thereof. 9. On a query put by this Court, Respondent Nos.2 to 4 state that they have entered into the settlement voluntarily, out of their own free will, without any force, coercion or undue influence. They further submit that they have received the aforesaid Demand Draft and have no objection if the present FIR and all consequential proceedings arising therefrom are quashed. 10. In view of the amicable settlement arrived at between the parties and the statements made by Respondent Nos.2 to 4 before this Court, no useful This is a digitally signed order. Continuation of the proceedings would only result in unnecessary litigation between the parties. In the peculiar facts and circumstances of the present case, and to secure the ends of justice, there is no legal impediment to quashing the FIR and the proceedings arising therefrom. 11. Accordingly, FIR No. 949/2014, registered at Police Station Nand Nagri, Delhi, for the offences punishable under Sections 279 and 304A of the IPC, along with all consequential proceedings arising therefrom, is hereby quashed. 12. The present petition stands disposed of. Pending application(s), if any, also stand disposed of. 13. The order be uploaded on the website forthwith.
