The two petitioners came forward with institution of present writ petition on 21.02.2026 invoking article 227 of the Constitution of India for challenging orders dated 27.12.2025 & 26.04.2023 passed by the trial court of Munsiff (District Mobile Magistrate (T)), Rajouri in a civil suit titled “Mohd Bashir Vs Ghulam Nabi and Another”. 2. On the very first date of listing of this case before the Bench on 06.03.2026, nobody was present on behalf of the petitioners. 3. On next date of hearing i.e., 11.03.2026, due to non- appearance of the counsel for the petitioners, the case was dismissed for non-prosecution, only to be restored back in terms of an order dated 30.03.2026. Regular Cause List Serial No. 03 2 CM(M) No. 38/2026 4. Upon restoration, the case was listed on 21.04.2026 when this Court directed notice to the respondent and also directed the Registry to summon the digitized record from the court below. 5. Today, the counsel for the petitioners is again found absent. This is a definite pointer to the fact that the filing of present petition is nothing but an abuse of the process of law.
