2. Heard the learned counsel for the Petitioners and the learned Assistant Government Pleader. 3 Dr. YLR, J W.P.No.1941 of 2026 Dated 23.01.2026
3.
The grievance of the petitioners is that respondent Nos.4 and 5 have been calling the petitioners to the police station and are allegedly interfering with their personal life and liberty. The learned Government Pleader for Home, on written instructions, submitted that the petitioners had visited the house of MettupalliMounika under the guise of prophecy through palmistry and astrology. After the petitioners left the house, certain valuable movable properties, including gold ornaments belonging to M.Mounika, were found missing. Consequently, she lodged a report with the police suspecting the involvement of the petitioners, and the said report was registered as Crime No.01 of 2026 of Vinjamur Police Station, S.P.S.R District on 08.01.2026 for the offence punishable under Section 303(2) of the Bharatiya Nyaya Sanhita, 2023 (for brevity, ‘the BNS’). 4. The learned Government Pleader for Home, on instructions, further submitted that the petitioners were called to the police station only once in connection with the investigation, a preliminary enquiry was conducted, and thereafter the petitioners were let off. However, the learned counsel for the petitioners contended that the petitioners were taken to the police station on several occasions, were assaulted and subjected to threats, and were repeatedly grilled by the police. 4 Dr. YLR, J W.P.No.1941 of 2026 Dated 23.01.2026
5. Considering the facts and circumstances of the case, Respondent Nos.4 and 5 are directed not to unnecessarily interfere with the personal life and liberty of the petitioners, otherwise than in accordance with due process of law. However, it is made clear that, if in the course ofinvestigation it is revealed that the petitioners have committed any offence, the police are at liberty to proceed in accordance with law. 6. In the result, the Writ Petition is disposed of. There shall be no order as to costs. As a sequel, Miscellaneous petitions, if any pending, shall stand closed. _________________________ DR. Y.
