JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioner is before the Court calling in question registration of a crime in crime No.36/2026 registered for offence punishable under Section 108 inter alia of the Bharatiya Nyaya Samhitha (BNS), 2023, which is Section 306 of the - 3 - HC-KAR NC: 2026:KHC:14759 CRL.P No. 3884 of 2026 Indian Penal Code, 1860, the earlier regime. Wife of the complainant commits suicide. The wife is a teacher in which the present petitioner is the Principal. The crime is registered on 13.02.2026. All the incidents have happened on 13.02.2026. Therefore, the Court is of the opinion that it is a matter for investigation. 2. Heard Sri. Mallikarjuna R.M., learned counsel appearing for the petitioner and Sri. Anoop Kumar, learned High Court Government Pleader appearing for respondent No.1. 3. The learned counsel appearing for the petitioner submits that being the Principal, he has a responsibility over 1,200 students, who are studying in the school and the Police should not disturb the examination that is being held in the garb of investigation. 4. In the light of the said submission, while disposing the subject petition, reserving liberty to the petitioner to knock at the doors of this Court in the event the Police would file a final report and that final report would go against him, I deem it appropriate to direct the Police not to disturb the student's - 4 - HC-KAR NC: 2026:KHC:14759 CRL.P No. 3884 of 2026 examination in the garb of investigation. The petitioner shall be permitted to perform his duties as a Principal while co-operate with the investigation as an accused in the case, as well. 5.
