To grant such other relief as this Hon'ble Court deem fit and proper in the circumstances of the case in the ends of justice.” 2. This writ petition is of the year 2025. The writ petition is field questioning the E-auction sale notice dated 26.09.2025. The respondent is the Repco Home Finance Limited, which is a private financial company. 3. In the light of the laid down by the Hon’ble Supreme Court in Phoenix ARC Private Limited vs. Vishwa Bharati Vidya Mandir & Others, in Civil Appeal Nos.257- 259 of 2022, a writ petition against the private financial - 4 - HC-KAR NC: 2026:KHC:15179 WP No. 32003 of 2025 institution is not maintainable and that apart, the petitioner has also not appeared before this Court. 5. In that view of the matter, this Court is passing the following: ORDER i. Accordingly, the writ petition is dismissed as not maintainable. ii. The petitioner is at liberty to avail appropriate remedy before the Debt Recovery Tribunal. iii. All pending IAs., if any, in the petition shall stand closed.
