In this writ petition, petitioner has initially challenged the report of the Enquiry Officer in the departmental proceeding and the charge-sheet on different grounds. 3. Now the respondents have punished the petitioner vide order dated 27.01.2026. The said order has been brought on record. 4. The petitioner submits that the said order has been communicated at 9:00 PM. Aforesaid cannot be a ground to set aside the final order. 5. The final order clearly suggests that the punishment order is appealable under Rule 38 of the Conduct, Discipline and 2026:JHHC:2099 2 Appeal Rules, 1980 of Indian Oil Corporation Limited. 6. Since the final order has been passed punishing the petitioner whereby the penalty of reduction of basic pay by one stage with cumulative effect has been imposed, I am not inclined to entertain this writ petition, as there is a provision of appeal. 7. The petitioner is directed to file a departmental appeal, taking all the points available to the petitioner, including the grounds taken in this writ petition which will be considered by the Appellate Authority and an appropriate reasoned order should be passed. 8. With the aforesaid observations, this writ petition stands disposed of. 9. Pending interlocutory application, if any, also stands disposed of.
