The petitioner has filed this Writ Petition under Article 226 of the Constitution of India seeking a direction to the respondent authorities to consider the complaint made by him and to evict/dispossess/remove the encroachers respondents No. 6 & 7 from mortgaged property of the petitioner. 2. Learned counsel for the petitioner would submit that in pursuance of the proceeding initiated under Section 14 of the SARFAESI Act, 2002, the Tahsildar has already handed over possession to the petitioner on 2-9-2025, but subsequently respondents No. 6 & 7 have forcibly broken the door of the house and entered into the premises. He would further submit that they have already made a complaint against the respondents No. 6 & 7 before the concerned Police Station, but no action has been taken against them. 3. Since the alternate and efficacious remedy is available to the petitioner, let the petitioner take alternate remedy available to him under Bharatiya Nagarik Suraksha Sanhita, 2023. 4. With the aforesaid observation, this writ petition is disposed of. 5. Pending interlocutory applications, if any, also stand disposed of.
